Terms of Service

These terms govern your use of Postroom’s services, including the postroom-hq.com website, the audit.postroom-hq.com platform, and any paid email management work we agree to deliver. By using the services you agree to these terms. If you don’t agree, don’t use the services.
Postroom is a trading name of The Garden Network Limited, a company registered in England and Wales (Companies House 16552976). When these terms say “we”, “us”, or “Postroom”, that’s who it means.
1. The services
1.1 Free email audit
We offer a free email programme audit at audit.postroom-hq.com. You connect your Mailchimp account using a read-only API key, we score your programme against our benchmark framework for UK Muslim charities, and we return a report. The free audit is provided as-is, with no warranty of any kind, and is intended as a starting point for conversation rather than as professional advice you should rely on without independent judgement.
1.2 Paid email management services
Postroom also delivers paid email programme management for Muslim-led organisations. These engagements are covered by a separate written agreement (a Statement of Work or Service Agreement) signed by both parties. In case of conflict between these terms and a signed Statement of Work, the Statement of Work governs.
1.3 Newsletter
We publish a newsletter for charity comms and fundraising professionals. You can subscribe and unsubscribe at any time. We don’t share or sell our list.
2. Your account and your data
2.1 Accurate information
When you sign up for an audit or enquire about paid services, you agree to provide accurate, current information. If anything changes, please update us.
2.2 Mailchimp credentials
If you choose to connect your Mailchimp account, you must use a read-only API key. You are responsible for ensuring the key you provide is scoped appropriately and for rotating or deleting it after your audit is complete. We will never ask for a full-access key. We use the key only to run the audit you requested. See our Privacy Policyfor what we read and what we don’t.
2.3 Your data, your control
You retain ownership of all data in your Mailchimp account. We retain ownership of the audit report we generate. You may share the report internally without restriction. If you’d like us to delete your audit data, email privacy@postroom-hq.com and we’ll do it within 14 days.
3. Acceptable use
You agree not to:
- Use the services to send unsolicited bulk email, spam, or any message that breaches UK GDPR, PECR, or equivalent law in your jurisdiction
- Provide us with Mailchimp credentials you are not authorised to share
- Attempt to reverse-engineer, scrape, or interfere with the audit platform
- Use the services to send content that’s unlawful, hateful, discriminatory, defamatory, or that infringes anyone’s rights
- Use the services to attempt to gain access to anyone else’s audit data or account
- Submit any data that includes personal data of third parties you do not have lawful basis to share with us
We may suspend or terminate access to the services if we reasonably believe these rules have been breached.
4. Intellectual property
4.1 Our IP
The Postroom audit framework, benchmark thresholds, scoring methodology, prompts, software, website copy, brand, and all related materials are the intellectual property of The Garden Network Limited. You may not copy, redistribute, or republish them without our written permission. The report we generate for you is yours to use internally; redistributing it externally requires our consent.
4.2 Your IP
You retain all rights to your Mailchimp account, your campaigns, your subscriber data, and any briefs or content you share with us. By submitting content to us, you grant us a limited, non-exclusive licence to use it solely to deliver the services you’ve asked for.
4.3 Aggregate insights
We may use aggregate, de-identified data from audits we run to improve our benchmark framework. We will never expose one charity’s data to another and we will never use one charity’s data to generate another charity’s report.
5. Pricing and payment
The free email audit is free. Paid services are priced and invoiced under the relevant Statement of Work. Unless agreed otherwise, invoices are payable within 14 days, in GBP, by bank transfer. Overdue invoices may accrue interest at the rate applicable under the Late Payment of Commercial Debts (Interest) Act 1998.
6. AI-generated content
Parts of our audit report and our outreach emails are drafted with the help of large language models (currently Claude, by Anthropic). We design the prompts, calibrate the framework, review the output, and stand behind what we send. You should treat the report as informed analysis rather than as professional or legal advice. If you spot anything inaccurate, tell us and we’ll fix it.
7. Warranties and liability
7.1 What we promise
We will deliver the services with reasonable skill and care. Paid services are covered by the warranties set out in the relevant Statement of Work.
7.2 What we don’t promise
The free audit and the postroom-hq.com website are provided on an “as-is” basis. To the extent permitted by law, we exclude all implied warranties (including warranties of merchantability, fitness for purpose, and non-infringement). We don’t guarantee that the services will be uninterrupted, error-free, or that the audit report will increase your revenue.
7.3 Liability cap
To the extent permitted by law, our total aggregate liability to you for any loss arising from your use of the services is capped at the greater of (a) £500 or (b) the fees you have paid us in the twelve months before the event giving rise to the liability. We are not liable for indirect, consequential, special, or punitive losses, or for loss of profit, revenue, goodwill, or data.
7.4 What we don’t exclude
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law.
8. Indemnity
You agree to indemnify us against any claims, damages, or expenses arising from (a) your breach of these terms, (b) your misuse of the services, or (c) content or data you’ve provided that infringes a third party’s rights or breaches UK GDPR, PECR, or other applicable law.
9. Suspension and termination
You may stop using the services at any time. We may suspend or terminate access if you breach these terms, if we’re required to by law, or with 30 days’ notice for any reason. Sections 4 (IP), 7 (Liability), 8 (Indemnity), 10 (Disputes) and 11 (General) survive termination.
10. Governing law and disputes
These terms are governed by the law of England and Wales. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales. Before going to court, both sides agree to try in good faith to resolve the dispute by direct discussion for at least 30 days.
11. General
- Entire agreement— these terms (together with any Statement of Work you’ve signed and our Privacy Policy) are the entire agreement between us
- No assignment — you may not assign or transfer your rights under these terms without our written consent. We may assign to a successor in connection with a merger or sale of the business.
- Severability — if any part of these terms is held unenforceable, the rest stays in force
- No third-party rights — these terms do not confer rights on anyone other than you and us under the Contracts (Rights of Third Parties) Act 1999
- Changes — we may update these terms from time to time. The current version always lives at postroom-hq.com/terms. Material changes will be notified by email to anyone with an active audit account or paid engagement.
